What is involved in purchasing property?

In South Australia, title to land is registered under the Torrens system governed by the Real Property Act 1886 (SA). When you purchase property, your ownership is not established until the transfer is registered at the Lands Titles Office and stamp duty has been paid under the Stamp Duties Act 1923 (SA). The conveyancing process covers reviewing and negotiating the contract of sale, ordering searches to identify encumbrances, managing finance conditions, and coordinating settlement. Electronic settlement is now conducted through PEXA in most transactions. We manage the entire process so your transaction proceeds smoothly and your interest in the property is properly protected.

What searches are required when purchasing property?

Do I need legal advice before signing a contract?

Getting advice before you sign gives you the greatest flexibility to address issues or walk away if necessary. In South Australia, the Land and Business (Sale and Conveyancing) Act 1994 (SA) requires the vendor to provide certain prescribed documents, and understanding what is disclosed before signing protects your position. What is PEXA and how does it affect my settlement?

PEXA is the electronic settlement platform used for most property transactions in South Australia. Settlement takes place digitally, with funds and the title transfer processed through the PEXA workspace on settlement day. We manage the PEXA workspace on your behalf to ensure settlement occurs at the agreed time.

What stamp duty will I need to pay?

Stamp duty is payable by the purchaser on the dutiable value of the property under the Stamp Duties Act 1923 (SA), calculated on a sliding scale based on the purchase price. Concessions apply in some circumstances, including for eligible first home buyers. We advise on the stamp duty payable and your total settlement costs before your settlement date.
